David M. Brodsky, the principal of Brodsky ADR LLC, is a mediator and arbitrator who is regularly retained by private firms to mediate or arbitrate complex public and private disputes. He has mediated over fifty complex disputes, including those concerning production supply contracts; dissolution of partnerships; disputes over retirement benefits; alleged violations of the False Claims Act in connection with Medicare and Medicaid reimbursements; insurance coverage disputes; breaches of fiduciary duty by officers and directors of public companies; violations of Federal Securities Laws and state Corporate Governance standards; violations of Generally Accepted Accounting Principles and auditor negligence; breaches of contracts and software licenses, enforceability of foreign arbitration awards, bankruptcy law violations,  compensation disputes, and other commercial or financial controversies.

As an arbitrator, David has been selected to chair or act as solo arbitrator in disputes as diverse as claims of accounting malpractice, breaches of investment advisory contracts, buy-outs of minority shareholder interests, insurance coverage, breaches of warranties in connection with sale of RMBS securities, and negligent installation of global software systems. He has been selected as a part of three-person arbitration panels in more than fifteen other complex matters. He is a Fellow of the American College of E-Neutrals and incoming Chair of the ADR Committee of the American College of Trial Lawyers  

David also has over 40 years of experience as a highly-regarded trial lawyer for plaintiffs and defendants in a wide variety of complex litigation, as well as a federal prosecutor and general counsel for an investment bank. He has published and spoken on a wide range of subjects.
